Accommodation Booking Terms and Conditions for Direct Renters

 PLEASE READ THESE TERMS & CONDITIONS CARFULLY

WHEN YOU MAKE AN ACCOMMODATION RESERVATION WITH TORCLIFFE, YOU ARE ENTERING INTO A LEGALLY BINDING CONTRACT, THE DETAILS OF WHICH ARE SET OUT IN THIS TERMS AND CONDITIONS DISCLOSURE DOCUMENT.

1. The contract for accommodation hire

The contract for a short-term holiday rental will be between Torcliffe (referred to as “us” or “we”) and the person making the booking.

The person/s making the holiday booking (referred to as “you” or “your”) in the following booking conditions. When Torcliffe and the person making the booking are referred to together, they will be described and labelled as ‘the Parties’

The contract of accommodation hire is not effective until we have received advance payment or agreed payment to an agreed time-frame for the accommodation being requested. The contract will be subject to these booking terms and conditions, which must be fully complied with.

The booking party leader must be at least 18 years of age at the time of the booking. The booking form, which we will either provide through our website or via email to the booking person’s nominated email address, must list the names and ages of the party who will be staying in the nominated accommodation at Torcliffe.

 

You must not use the property except for the purpose of a holiday / leisure break during the period specified and not for any other purpose than that stipulated in the booking.

The agreement for you to stay in the property for the stipulated period and the stipulated purpose does not create the relationship of Landlord and Tennant between the parties.

  1. Duration and times of lettings
    Unless Torcliffe makes alternative arrangements with you and communicates and early check in time slot for you, you should not arrive at the accommodation before 4pm on the commencement check-in date.

    You are required to leave by 10am on the day of departure. If you wish to have a late check-out, please contact Torcliffe reception by email to service@torcliffe.com

If you arrive outside of our office opening hours, access to your accommodation may be granted courtesy of a pass-code lock box. This pass-code lock box will be located close to the door of your accommodation. If we know you are arriving out of hours, we can send you a link video, so you know how to find your apartment.

 

  1. Late check outs

Our ability to allow late check outs depends on the incoming guest and cleaning provisions. If we can allow late check outs, this will be free of charge for one hour but then charged at a rate of £15 per hour thereafter.

Failure to check out at the required time gives Torcliffe the rights to charge you a further day’s rental, as our inability to access and clean the apartment to the timescales we require may mean we cannot fulfil follow on bookings.

4. Booking Methods

All direct applications to book holidays at Torcliffe must be submitted by you using our standard booking methods. For direct bookings, this can be arranged via our website at https://torcliffe.com/contact-us We can also take bookings over the telephone and via email.

All the information requested by us in the booking process must be provided to secure your booking. 

 

  1. Payments & deposits

The following payment rules apply to all direct bookings:

 

  1. For bookings that are made outside 6 months of the check in date, a 25% deposit will be required to secure the booking. The balance must be paid at least 2 weeks before the check in date.
  2. For bookings that are made inside 3 months, a 50% deposit will be required. The balance must be paid at least 2 weeks before the check in date.
  3. For all bookings made inside one month of the check in date, full payment amount will be required at the time of booking

Payment for accommodation can be made via credit, debit or direct bank transfer.

 

  1. Changes to bookings
    We will reasonably consider any request, subject to availability, to change booking dates after confirmation has been issued. If your request to alter a booking involves an upgrade to a higher season, we will quote you a booking change fee. We may ask you to immediately pay this booking change fee to secure your updated booking.

 

  1. Cancellations

We strongly recommend that all guests take out appropriate holiday insurance.

Any request to cancel your booking must be made to us in writing by letter, email or via telephone during normal office hours. You shall remain liable for all the payments due in respect of the reservation whether or not they have been paid at the time of the cancellation.

In the unlikely event that we (Torcliffe) cancel your booking, the full amount of the booking fee and booking amount will be refunded to you.

If you cancel a booking outside of six weeks of the check in date, we will refund you in full.

If you cancel your booking inside two weeks of the check in date, we would charge you the full booking price. This is because we may not be able to rent out the accommodation again in the two-week period.

If you have been quoted a non-refundable rate, no monies will be refunded in the event that you cancel your booking at any time.

 

  1. Failure to pay
    If you are not responsive to our attempts to collect any advance payments from you, we may cancel your booking and no deposits will be refunded. If we do cancel your booking because of non-payment, we will telephone, sms and email you to make you aware of the cancellation.

 

  1. Occupancy the property
    The maximum number of persons stated for occupancy at our is 4 people for a 1-bedroom

For insurance reasons, we cannot allow these maximum numbers to be exceeded. Any such over-occupancy is considered to be a serious infringement of these Terms and Conditions and may result in an immediate request for you to vacate the premises, with no refund of monies being due to you.

 

  1. Damages

All our accommodation is cleaned and inspected prior to new guests checking in and is recorded as being free from faults or damage. We also make an inventory check of all items inside the accommodation.

 

You are responsible for the care of the property and are expected to take all reasonable care in your use of furniture, pictures, fittings and effects, in or on the property. You must leave them in the same state of repair, and in the same clean and tidy condition at the end of the rental period as you experienced at the beginning of your stay at Torcliffe.

 

You must not use the properties for any dangerous, offensive, noxious, noisy, immoral activities or carry on there any act that may be a nuisance or annoyance to the owner or other neighbouring properties.

You are required to keep noise to a minimum between the hours of 10pm and 7am. Please do not play loud music. Smoking is not allowed in any of the properties, inside the facilities or in any communal areas at any time. This includes use of e-cigarettes.

If you do cause any damage to be made to the fixtures, fittings or crockery, you must notify us. The damage will be charged to you at the replacement and repair cost. This cost must be settled before you leave Torcliffe.

 

 

 

  1. Authorisation

You confirm that you are authorised to sign the booking form on behalf of all persons who will occupy the property and that these guests are aware of the Torcliffe booking conditions.

We must receive names and contact details of all guests who don’t live with you to comply with our insurance rules and government Covid-19 track and trace guidelines. 

 

  1. Vehicles, car parking and bikes

Torcliffe has ample car parking space for our accommodation. Our rules are that you can have one car. However, if you contact us in advance, we may be able to allow you to park a second vehicle.

Our car park is not suitable for trucks, long wheelbase vans or caravans.

If you bring bikes, you are not allowed to store these in your accommodation. By prior arrangement, we may be able to find secure space for you to store the bikes.  

 

  1. Force Majeure
    In these terms and conditions “Force Majeure” means any circumstances beyond our reasonable control including, without limitation, an Act of God, Fire, Global Pandemic, Flood, War or Acts of Terrorism. If by reason of Force Majeure the property is not available at the commencement of the time booked by you or the property is unsuitable for letting at that time, we shall not be deemed to be in breach of contract but shall refund in full to you all fees, charges and any deposit paid in advance by you. You will also have the option of taking a credit to book your accommodation at another time.

We will not be liable for any other claim for loss or damage by you.

  1. General
    In the event of any conflict between these booking conditions and any other contents of any brochure or website, the conditions contained herein shall prevail.

These terms and the contract between you and us shall be subject to and interpreted in accordance with the British Courts.

 

  1. Pets

Torcliffe allow dogs but we charge an extra cleaning fee. Guests with noisy dogs will not find Torcliffe suitable and should seek alternative accommodation.  

 

  1. Data security and privacy
    Torcliffewill ensure that personal data is only used for the legitimate interests of the business and does not unduly prejudice the rights and freedoms of the individual in question. Personal data will be processed fairly and lawfully in accordance with the General Data Protection Legislations.

Access to all of your held data can be granted to computerised personal data in the form of a computerised “printout”.

 

Personal data will be kept only for so long as is necessary for the specified purposes.

  1. Disclaimer
    Please be forewarned that it is possible to catch computer viruses by accessing a web page or by downloading or running an infected program. Whilst Torcliffehas taken reasonable steps to ensure that the pages on our web site and our email system are free from infection, such is the nature of the Internet that no assurances can be given that they are free from infection.

It is a condition of us allowing you free access to the website that Torcliffewill not be liable for any loss or damage suffered by any person accessing this website or any third party resulting directly from the transmission of a computer virus resulting from the accessing of this website.

Torcliffe operates a strict cleaning regime to prevent the spread of germs, diseases and infections. This includes use of cleaning procedures and materials to address the Covid-19 pandemic of the year 2020.

 

Social distancing guidelines and policies linked to the use of our public areas and facilities are also in place and these are clearly communicated to you in writing before and during your stay. Torcliffe has taken all reasonable action to reduce the chance of any guest catching any infection whilst staying at Sutton Hall. However, in staying at Torcliffe you and your guests accept that it is not the responsibility of Torcliffe if any virus, disease or infection is contracted during your stay at Torcliffe and through the conduct of accepting these terms and conditions and staying at Torcliffe, you are indemnifying Torcliffe from any associated medical or health claim that may arise.      

 

  1. Changes to these terms and conditions

Terms and conditions are subject to change. Torcliffe reserves the right to change these t&cs at any point. However, no changes will be designed to have a measurable detrimental on any existing guest bookings.
